Sutherland Shire Local Environmental Plan (LEP)

A Local Environmental Plans (LEP) is the main tool we use to guide planning decisions and control the development of land in Sutherland Shire.

The LEP shapes our community and ensure development is carried out appropriately by providing rules for development, such as land-use and building height. We review our LEP at least every five years and make changes  through Planning Proposals.

Zoning specifies what land uses are permitted and if planning approval is required.

LEPs set objectives for each zone and determine permitted uses.

Employment zones

New employment zones commenced 26 April 2023 within the Sutherland Shire Local Environmental Plan 2015.

Any mention of a former industrial or business zone, is legally taken to be a mention of one of the new employment zones. This applies to any document or contract, including property sales contracts.

From 26 April 2023, in a document (other than a state environmental planning policy) a reference to a former zone under an environmental planning instrument is taken to include a reference to a new zone under the environmental planning instrument.  Note: Document means an Act, statutory or other instrument, contract or agreement, and includes a document issued or made under or for the purposes of an Act or statutory or other instrument.

We will continue to apply the Sutherland Development Control Plan 2015 based on the former zones until it is updated to reflect the new employment zones. There are temporary savings and transitional provisions applying to development which would be prohibited by the new zones.
