Voluntary Planning Agreements (VPA)

Voluntary Planning Agreements (also commonly referred to as VPA's) are legal documents created under the Environmental Planning and Assessment Act 1979 (EP&A Act). VPA's are between developers and government agencies (including Council). VPA's provide for the provision of funds or works by the developer for infrastructure, services or other public amenities or benefits typically negotiated at the time of rezoning or a development application. The funds or works are not required to have a direct nexus with the proposal, but should be related. VPA's are separate from, but complement Council's Development Contribution Plans.

The land to which the agreement applies is the following:

Lot 315 in DP 1232026 at 457 Captain Cook Drive, Woolooware or any lots arising from the subdivision of Lot 315 in DP 1232026

The Planning Agreement requires the Developer to make a monetary contribution of $1,400,000 to Council for the provision of new bicycle links, to provide 5% of residential floor space in the development for affordable rental housing, and to reserve 5% of apartments in the development for first home buyers.

The land to which the agreement applies is some or all of the following:

This agreement was entered into
on 16 August 2018. The agreement sets out:

(ii) construction and full embellishment of a public park within the re-defined Council land at the developer’s expense.
