Planning Proposals

A Planning Proposal is a document which outlines a proposed amendment to the rules set out in Council's LEP. A Planning Proposal may be initiated by Council or be submitted by a private applicant. A typical Planning Proposal may include a rezoning as well as an increase to maximum allowable height and density. 

An assessment is carried out by Council's planners who then prepare a report to Council. If Council decides the proposal has sufficient merit to proceed to community exhibition, it will be referred to NSW Planning and Environment for a gateway determination. If a gateway approval is given, the proposed LEP amendment will be publicly exhibited, usually for 28 days. The community and affected property owners are notified of the Planning Proposal and invited to make comment. During this time, the public can make written submissions on the proposal. A person making a submission can also request a public hearing be held. All submissions are reported to Council to be considered as part of the elected Councillors' final decision on the proposal. 

If Council decides not to support the proposal, the applicant can ask NSW Planning and Environment for a Pre-Gateway Review/Rezoning Review, and the proposal may still proceed to an LEP amendment. The review would be conducted by the Sydney South Planning Panel.

Amendment to SSLEP2015 to introduce minimum lot size requirements for Dual occupancy and Multi dwelling housing in specific zones. This Council initiated amendment implemented a minimum lot size requirement for Dual occupancy of 600m2 in the R2 zone and 700m2 in the E4 zone.

The amendment also  implemented a 1200m2 minimum lot size requirement for Multi dwelling housing in the R2 zone.

On 19/04/2018 Council was formally advised that the Sydney South Planning Panel had considered the proposal through a Rezoning Review and determined that it should not proceed to a Gateway Determination. Further information on this decision is available from the SSPP website.
