Planning Proposals

A Planning Proposal is a document which outlines a proposed amendment to the rules set out in Council's LEP. A Planning Proposal may be initiated by Council or be submitted by a private applicant. A typical Planning Proposal may include a rezoning as well as an increase to maximum allowable height and density. 

An assessment is carried out by Council's planners who then prepare a report to Council. If Council decides the proposal has sufficient merit to proceed to community exhibition, it will be referred to NSW Planning and Environment for a gateway determination. If a gateway approval is given, the proposed LEP amendment will be publicly exhibited, usually for 28 days. The community and affected property owners are notified of the Planning Proposal and invited to make comment. During this time, the public can make written submissions on the proposal. A person making a submission can also request a public hearing be held. All submissions are reported to Council to be considered as part of the elected Councillors' final decision on the proposal. 

If Council decides not to support the proposal, the applicant can ask NSW Planning and Environment for a Pre-Gateway Review, and the proposal may still proceed to an LEP amendment. The review would be conducted by the Sydney South Planning Panel.

Council has prepared a Planning Proposal Mapping Tool to show the extent of all Draft Planning Proposals which have received a Gateway Determination.

SSLEP2015 Amendment 4 (Housekeeping)

Council initiated housekeeping amendment seeking to amend both LEP document and Maps. Includes  errors and anomalies identified in initial use of the plan.

A Gateway Determination has been issued by the Department of Planning and Environment. This amendment was exhibited from 3 August to 1 September, 2016. On 19 December 2016, Council resolved to amend this proposal in response to community submissions. It is currently with Parliamentary Counsel to be legally drafted. Sutherland Shire Council has delegation to make this amendment.

 SSLEP2015 Amendment 8 (Reclassifications)

This Council initiated amendment contains the land reclassification proposals which were initially part of Amendment 4. The purpose of this amendment is to reclassify land from "community land" to "operational land" and to rezone a portion of land at 2R Alexander Ave, Taren Point. Gateway Determination from the Department of Planning and Environment received on 30 June 2016. This amendment was exhibited from 20 July to 1 September, 2016. A public hearing was held on the 28th of September.

Council resolved to proceed with an amended version of this planning proposal. The draft  is currently with Parliamentary Counsel to be legally made/gazetted.

Independent Facilitator's Report on the Public Hearing
 SSLEP2015 Amendment 7 (Other Policy Amendments) The Planning Proposal seeks to address outstanding issues from the finalisation of SSLEP2015 which required public exhibition, resolve other issues which were previously raised in submissions to SSLEP2015 and respond to issues which have been identified since the Plan came into force. Amendment 7 includes a number of rezonings, policy amendments and changes to the Heritage Schedule including the removal of items consistent with the Sutherland Shire Community Based Heritage Review. N/A   
Gateway Determination was received from NSW Planning and Environment on 8 September 2016. Council has been directed to remove the following from the Planning Proposal as these do not comply with s117 Directions:
  • Proposed rezoning of 327 properties in Gymea Bay from R2 Low Density Residential to E4 Environmental Living
  • Proposed amendments to the objectives of the B1 Neighbourhood Centre zone
  • Proposed rezoning of Carol Avenue Reserve, Jannali
  • Proposed removal of a stand of eucalyptus and single fig tree at Prices Circuit Crown Reserve, Woronora from the heritage schedule (Item 4206).
The Gateway Determination also requires an Initial Evaluation under SEPP 55 (Contaminated Land) to be undertaken for the proposed rezoning of land at Bates Drive before the Planning Proposal can be placed on public exhibition.

This proposal was exhibited from 09 November to 08 December 2016. A report summarising the submissions to the exhibition will be presented to the next Council meeting in March 2017.

The Planning Proposal was initially exhibited for a total of 29 days from 6 July to 3 August, 2016; however at Council’s meeting on the 15 of August, it was resolved to extend the exhibition for a further 14 days to 29 August, 2016.

The amendment was gazetted as Sutherland Shire Local Environmental Plan Amendment No. 7 on the 17th of March 2017.

Gateway Determination was received from NSW Planning and Environment on 25 November 2016. The Planning Proposal was placed on exhibition from the 21st of December 2016 until the 31st of January 2017.

A Public Hearing was held into the proposal at 6:30PM on Thursday 23rd of February 2017, on Level 2 at Council's Administration Building at 4-20 Eton Street, Sutherland. The independent facilitator of the Public Hearing has provided a report to Council summarising the comments. The report can be viewed online, or on paper at Council's Administration Building.
