Height

What are height controls?

Height (along with floor space ratio) controls are effective tools to control the bulk and scale and the intensity of development. These controls are important to establish the character of the area, and how the development relates to adjoining development and the public domain.  Height controls also affect solar access for surrounding properties.

The height of development is constrained by a control specifying the maximum allowable height of building. Unlike in LEP 2006, in the LEP 2015 maximum building height limits are defined in metres above ground level, rather than in storeys. It is considered that the overall height of a building has greater visual impact than the number of storeys

How does LEP 2015 address height?

Maximum building heights are set out in LEP 2015 Clause 4.3 Height of buildings, and displayed on the Height of Buildings Map.

Additional clauses governing building height have been added to address particular uses on certain site where an alternate height limit could be appropriate.

Such development may need to achieve defined planning objectives; examples include the Caringbah medical area adjacent to the Sutherland Hospital or in town centres where significant public space or benefit results from the development. Thus, different maximum heights may be applied to different zones and for different locations within the same zone.

Exceptions

Height of building controls may be varied under Clause 4.6 Exceptions to developmdraent standards.  In addition, the maximum height limit of a building may be varied in some circumstances through Clause 5.6 Architectural roof features.
