Do I need approval?
You will not need approval if the proposed subdivision meets the relevant development standards for exempt development. You can find the relevant standards in the NSW government's State Environmental Planning Policy (Exempt and Complying Development Codes) 2008.

If the proposal doesn't qualify as exempt development, you may be able to apply for a Complying Development Certificate or a Development Application.
Can I apply for a Complying Development Certificate?
A Complying Development Certificate may be issued for the strata subdivision of a building, other than a dual occupancy, secondary dwelling, boarding house or group home if the proposal meets the relevant development standards. I need a Development Application. What do I do?
Council may grant development consent for subdivision if the proposal meets the relevant planning controls.

Do I need a Subdivision Certificate?
Before you register your proposed subdivision with the NSW Land Registry Services you will usually need to apply for a Subdivision Certificate from Council. You will need to engage a registered surveyor to prepare subdivision plans.
If your subdivision relates to a dual occupancy, or other development that needs to be completed before the subdivision is registered, you will need to provide a copy of the occupation certificate and works-as-executed plans. You will also usually need a certificate from Sydney Water.
