Do I need approval?

You will not need approval for demolition of exempt development that does not involve a heritage item.

If the proposal doesn't qualify as exempt development, you may be able to apply for a Complying Development Certificate or a Development Application.

Can I apply for a Complying Development Certificate?

Complying Development Certificate may be issued for the demolition of the following development if the proposal meets the relevant development standards:

  • a dwelling
  • ancillary development (decks, carports, pergolas, etc)
  • a swimming pool
  • an industrial building
  • a commercial building

You can access the NSW Demolition Code to check whether your proposal is complying development. Complying development cannot be carried out on land containing a heritage item.

If the proposal doesn't qualify as complying development, you will need to lodge a Development Application.

I need a Development Application. What do I do?

Council may grant development consent for demolition if the proposal meets the relevant planning controls.
