Terms and conditions of hire

1.     The Booking Contract must be signed and returned to the Sutherland Entertainment Centre along with a minimum non-refundable deposit of $1500.00 per event per day for the Auditorium or $250.00 per day for the Black Box (Please refer to Fees and Charges for late payment charges).

2.     In the event of cancellation, a deposit refund (less administrative charges) will be given only if a similar income function is secured by the Centre in place of the cancelled event. Any refund amount is decided upon arbitrarily by the Events and Performing Arts Manager and is not subject to negotiation.

3.     Auditorium hire rates include one technician for 9.5 hours per day, not including a minimum ½ hour meal break. An appropriate pause in proceedings must be scheduled to ensure the duty technician has the opportunity for a meal break after a maximum of five hours. After 9.5 hours a charge of $90 per hour will be will apply for each hour or part thereof. Any Hirer whose schedule does not allow for a meal break will need a 2nd technician to be engaged, with a minimum 4 hour call at the standard hourly rate.

4.     The Hirer must provide written evidence of public liability insurance cover of not less than $10 million noting Sutherland Shire Council’s interest. Access will be denied if this condition is not met.

5.     The Hirer shall indemnify Council against all actions, suits, claims, demands, proceedings, losses damages, compensation, costs (including solicitor and client costs) charges and any expense whatsoever in respect of any personal injury caused or contributed to by the negligent act or omissions, breaches of contract or breaches of statutory duty of the Hirer, its servants, members, invitees or agents or damage to equipment or any other property of the Council or any other person or corporate body, or any infringement, disturbance or destruction of any rights of any person or corporate body arising out of, or incidental to, the use of the premises, property or facility by the Hirer and caused by the Hirer, its servants members, invitees or agents.

6.     Production consultancy and design is charged additionally depending on client requirements. If your production requires extra production staff, a charge of $90 per hour will be applied for a minimum 4 hour call per staff member engaged. Please enquire at time of booking.The Events and Performing Arts staff are always in charge of activity within the Centre.

7.     Four hour rehearsal rentals include fixed work lights, a CD player and one announcer’s microphone. Where a technician is required, the normal rate will apply.

8.     Occupation of the building beyond midnight (including bump out) will incur additional charges at the rate of twice the applicable hourly rate.

9.     In addition, Events and Performing Arts Management reserves the right to engage and charge the client for security personnel to be in attendance when the building is occupied after midnight.This will be at the rate of a minimum 4 hour call-out @ cost plus 10%.

10.     An additional cleaning fee may be charged if deemed necessary.

11.     A portable lift to provide stage access for wheelchairs is available. Arrangements for its use must be discussed with Events and Performing Arts management well in advance of the event as stage props and other equipment may interfere with its placement.

12.     All activities within the Sutherland Entertainment Centre during the period of hire must comply with the provisions of the Work Health and Safety Act 2011 and Work Health and Safety Regulation 2011. All Hirers and performers must comply with the instructions of the Centre’s Duty Manager.

     The Hirer acknowledges and agrees for the purpose of the Work Health and Safety Act 2011 (NSW) (“the Act”) that the Hirer conducts a business or undertaking for the purpose of section 20 of the Act, has management or control, in whole or in part, of the Centre and must ensure, so far as is reasonably practicable, the health and safety of:

          a)     workers engaged, or caused to be engaged by the person, and

          b)     workers whose activities in carrying out work are influenced or directed by the person, while the workers are at work in the business or undertaking.

13.     In order to comply with the Sutherland Entertainment Centre Evacuation Plan, two ushers/safety attendants are included for each concert or theatre-style event. The presence of these staff does not negate the need for a normal complement of ushers. Please enquire when booking.

14.     Due to safety requirements, Hirers utilising their own ushers must ensure all ushers attend the safety briefing conducted by the Sutherland Entertainment Centre Duty Manager one hour prior to a performance. If the ushers are minors they must be fully supervised by a competent adult.

15.     All portable electrical equipment brought onto the premises must be tested and tagged in accordance with Australian Standard and New Zealand Standard AS/NZ 3760, In-service Safety Inspection and Testing of Electrical Equipment.

16.     Hirers must subject inflammable materials brought onto the premises to appropriate anti-fire treatment. Relevant licences must be obtained by the Hirer for use of pyrotechnics with prior permission sought from Centre management for the use of pyrotechnic devices within the building.

17.     Confetti is prohibited from the Centre.

18.     Clients must not exceed authorised venue capacity and must abide by health and safety regulations, including those pertaining to consumption of alcohol in the work place.

19.     The Sutherland Entertainment Centre is fully licensed and Hirers, their guests/customers are not permitted to bring alcoholic beverages onto the premises.

20.     For safety reasons prams, capsules and strollers are not permitted within the theatre at any time.

21.     Blocking aisles or passageways with equipment (including video) or by sitting in them is not permitted at any time.

22.     Rates and conditions of hire alter infrequently but may change without notice.

23.     The Centre may exercise discretion in acceptance of bookings and may negotiate additional conditions of hire.

24.     The client will ensure all necessary performing rights and licences have been obtained prior to any performance(s).

25.     Council is not responsible for any loss or damage to any property belonging either to the Hirer or any person attending the function/event.

26.     Clients placing deposits acknowledge they have read all of the above terms and conditions and accept all of these terms and conditions.

27.     A maximum of 4 ‘house seats’ may be retained by the Centre for each and every performance. These may be utilised for promotional purposes.

28.     The Centre reserves the right to promote upcoming events and other activities prior to the commencement of the Hirer’s performances, and after the event. If scenery and other production items do not obscure the cyclorama, this may include the projection of ‘coming soon’ messages on the cyclorama prior to any performance.

29.     The Hirer gives permission for the venue to record up to 5 minutes of any performance in the Centre, and unlimited pre and post event interviews with patrons.The Hirer acknowledges that such recordings would be owned by the Venue.The Venue may only utilise such recordings for promotional purposes, and undertakes that any copyrights contained within them will be respected in any use of the material.
